NFA levies $2,000,000 monetary sanction against FXCM and orders refunds to customers

August 12, Chicago - National Futures Association (NFA) has issued a Decision imposing a $2,000,000 monetary sanction against Forex Capital Markets LLC(FXCM) in settlement of a Complaint issued by NFA's Business Conduct Committee on August 12, 2011. The Complaint cited FXCM for retaining gains derived from asymmetrical positive price slippage; failing to adopt or carry out adequate procedures to ensure the efficient execution of all customer orders; failing to treat all customers equally when giving price adjustments; failing to adequately investigate suspicious activity in several customers' accounts; and - together with its principal Dror Niv - failing to supervise. FXCM is a Futures Commission Merchant, Retail Foreign Exchange Dealer, and Forex Dealer Member located in New York, New York.

In addition to the $2,000,000 monetary sanction, FXCM must credit the accounts of its customers the amount of asymmetrical positive slippage which its customers experienced on their trades from and after June 18, 2008 and provide verification to NFA of these credits. In the future, FXCM is prohibited from engaging in price slippage or margin liquidation practices, as described in the Complaint. FXCM must also enhance existing procedures to ensure efficient execution of customer orders and compliance with NFA's anti-money laundering requirements.

I previously posted 3 demo accounts for Jasmine, Leah & Sienna and 3 real accounts for Jasmine, Leah and Sienna. People were getting confused that I only trade with demo accounts. I decided to remove three demo accounts so that people will only be able to view my three real accounts. The trading systems are still the same i.e. Jasmine, Leah and Sienna.

when I saw your systems here, I have contacted with you and asked some questions. In that discussion you have advised me in the case of I fund you, you would like to divide the fund into min 2 of your systems. Which is very smart.

But when I look your portfolio graph, more or less all your systems are doing the same moves except the amplitude.

so is this really giving your clients dividing their risk into some parts or they feel like that.

this is not offense. I would like to learn your idea.

All of my trading systems are designed with macro view in mind. For example, the monthly and year results will be different for each trading systems. Have a look at the comparison table below

Jasmine: June = -491 pips , July = +674 pips, August = +927 pips
Sienna: June = +1,016 pips, July = -349 pips, August = +1,857 pips

There are days, and weeks where the trades are similar to each other; however, the quarterly and yearly results will be different. No one trading system will be profitable under all market conditions for an extended period of time. The market moves constantly from uptrend, downtrend, and sideway market. It is best not to place all the eggs in one basket using just one trading system but rather to diversify with several different trading systems. The key is to select trading systems that are non correlated i.e. they all are not supposed to win at the same time over a period of 3 months and they are not supposed to lose at the same time over a period of 3 months.

if I have fund those with %50 + %50 in ~3 months the average P/L % would be % -57.30

I guess this is a different result what you mentioned on your last post and proof of my suggestion about same type of trades.

I have made a video called FAQs on my homepage on the right hand side. If you watch it, you will see that I always encourage people not to turn on the system live or compound the trading lot size when the system is winning. The best time to use the trading system is when it is losing. The live accounts of Leah and Jasmine are currently set on aggressive setting and are not for everyone. If you read the instruction on the website you will see that we posted the following info:

Here are the trading lot sizes based on risk.
Conservative: $20,000 capital, trading lot size is 0.1 lot, 1 pip = $1.
Each trade is risking approx. 0.5% of the account; hence, low volatility is observed in the account.

Moderate: $10,000 capital, trading lot size is 0.1 lot, 1 pip = $1
Each trade is risking approx. 1% of the account; hence, medium volatility is observed in the account.

Aggressive: $5,000 capital, trading lot size 0.1 lot, 1 pip = $1
Each trade is risking approx. 2% of account; hence, high volatility is observed in the account.

From what I can tell, you are a conservative or moderate trade; hence, you drawdown will only be 30% or less.

I apologize for being absent in posting the updates in the past two months. I have been working to release three additional EAs. These EAs will utilize different algorithms approach with as much as 80% winning trades. As with high winning trades, the take profits will be smaller and the stop loss will be larger. I think that these EAs will compliment my current portfolio of expert advisors where their winning percentages are only 50%.
